Town bans bottled water

CONCORD - Voters here banned the sale of drinking water in plastic bottles in town, as of next Jan. 1, during Town Meeting's final session Thursday night.

"Selling water in plastic bottles is the triumph of perceived need over real need," said Jean Hill, who drew up the measure.

Selectman Dinny McIntyre said while the selectmen applaud Hill for bringing up the idea, the board recommended taking no action because members do not believe Town Meeting has the power to enact a ban.

"Why don't we just pass it and then you can find out?" responded Bob Lawson.

Reached by phone yesterday, selectmen Chairman Stanly Black said while he agrees with the majority of his board that Town Meeting does not have the authority to actually ban the sale of drinking water in plastic bottles, he was "so moved by Jean Hill's presentation" that he switched his voted in favor of the measure.

"The statistics about the amount of trash are appalling. There's an island bigger than Texas floating around in the Pacific," Black said.

Town counsel has already given the opinion that this measure would be open to scrutiny under the dormant commerce clause as possibly discriminating against interstate commerce.



Other cities and towns have adopted less extreme measures, such as stopping spending municipal funds or taxpayer dollars on bottled water. Last year, town meeting in Bundanoon, in rural Australia, voted to ban the sale of bottled water.

Nick Guroff, communications director for Corporate Accountability International, a Boston organization that has a "Think Outside the Bottle" campaign, said to his knowledge, no other American municipality has passed such a ban.

"A ban is a big move," said Guroff, adding that the organization he represents only advocates for governmental and organizational actions.

"It's not something we'd advocate on a broad level," Guroff said of the ban. "Frankly, the approach we've taken is to support local control."

Before passing Article 65, Town Meeting voted to amend the measure to specifiy bottled drinking water, after Jimi Two Feathers said the article as printed in the warrant water in plastic bottles would also ban the sale of distilled water.

Yesterday, Black said he did not know the ban's impact on products such as Vitamin Water and other flavored waters, including OWater, a growing company headquartered in Concord.

Why can't people who don't want bottled water just boycott the bottled water?

It is also rather funny this law was past just two days before the Commonwealth put a boiled water order into effect which has sent bottled water sales to astronomical levels.

Normally I agree that bottled water is a bit silly, but then comes along something like what's going on in Boston right now.
