No you're correct, it's not fair but the team had another option. Just because Mondesi is in breach of contract doesn't mean that PIT has to relinquish it's rights to the contract. They chose to do so but they didn't have to.

Let's take your Soriano example. In this case I bet that the Rangers would still maintain rights to Soriano except they wouldn't have to pay him. Now they still have the right to trade him they just don't have to pay him while they are shopping him around.
