Ive read in a few places that due to the new 20 mil capped posting fee, if Rakuten doesnt post Tanaka this year, its likely he wont be posted at all, and thus may not come to MLB until he is an unrestricted FA after the 2015 season.

But what has been stopping them from posting Tanaka before the new rule is offical?
Is it it just a gentlmens agreement between MLB/Japan? Or would MLB legally prevent any team from negotiating until the new rule is finalized?

They have stated publicly that they won't post Tanaka until he states that he does in fact want to be posted.

They're hamstrung by the new agreement but $20 mil is better than nothing. Every indication, with little left to prove in Japan, is that he wants to come to MLB.
