I think that my call would depend on how you handle it when a player is sent to the minors (not including rehab assignments) during the season.
Say a guy struggles and is sent to the minors in June. What happens?
Also, say a guy gets released. What happens to him?
Assuming in both situations that they may remain on a team's roster, I would say to just simplify and allow any player that is on the current active roster to be drafted or otherwise obtained. Each MLB team has an official website where you will find their current roster. Anyone on the 40-man that is not noted otherwise should be considered on the current active roster.
Set a cutoff date for the player pool to be frozen before the draft. Say 9pm 2 days prior to draft time. Use the official team site's rosters at that time to determine player eligibility. The league manager may need to open each team page and copy/paste their rosters into a document so you have a definite record of what the rosters were at freeze time.
