Please let me know in which U.S. state a .09 BAC would be considered a "non-event." Thanks-
i stand partially corrected. i was not aware that every state had finally gone to .08 rather than .10. I amend my statement to say: "wrong state/year".
i find it ridiculous to make a big deal about a situation that would not have existed a few years ago.

what does passed out at a stoplight with the vehicle running mean?
it means he was tired more than anything else.
non-event.
right. right. i forgot. its perfectly safe to get behind the wheel when you are so tired you fall asleep at a stop light. nothing wrong with that. non-event.
i know a lot of other people have done a lot worse, but tony just did some real stupid things.

Manager Tony La Russa was arrested Thursday morning and charged with a DUI after he was reportedly found asleep at the wheel while at a stop light. La Russa's SUV was said to be stopped at a light through two cycles and he was initially unresponsive when police knocked on the window. His blood blood alcohol level was .093, which is over Florida's legal limit of .08.

i didn't say it was safe to drive tired, but if there was a news flash that said "LaRussa found asleep at stoplight after being tired", there would not be a thread. Given the BAC level, this is a (non)story about being tired. whoopdeedoo.

i dont think its appropriate to judge a situation based on the end result. its ok because he managed to keep his foot on the brake when asleep? what if he creeps into the intersection and causes and accident?
look, he failed the field tests. he failed the breathalyzer. BAC isnt a universal judge of impairment. you can spout .09 is nothing all you want but tony was judged by officers of the law to be impaired.
if its a non-story its because no one was hurt. its not a non-story because he did nothing wrong.
