Regarding consitutions, one important thing is to be prepared for any eventuality. Many leagues were thrown into turmoil last year when a work stoppage/strike/lockout looked possible, simply because their constitutions didn't account for this possibility. Some arguments over whether the season would have to be annulled or whether the leader would be declared the champion turned pretty bitter; a comprehensive constitution could have avoided this. Touch all the bases!
Another detail that's important to me is that the commish must never be seen as gaining an unfair advantage from this position. In my league, the commish has the tie-breaking vote in all decisions except those involving his or her team, which the commish automatically loses.
